Obama drops E-verify extension — what now?
Filed under: Applicant background screening, Security and law, Special Report

Though provisions to extend E-Verify were dropped from both the economic stimulus package and President Obama’s budget plan, the electronic employment verification system isn’t going away just yet.
The program was scheduled to expire this month, but the budget authorization signed by Obama last week will keep E-Verify running until at least September 30. The original version of the bill would have extended the program’s funding for five years, but that amendment was dropped.
Early versions of Obama’s stimulus bill also included a five-year extension, as well as a provision requiring any company receiving stimulus funds to use E-Verify for new hires. Both those provisions were removed from the final bill.
No money was added for the six-month extension, but the Department of Homeland Security says E-Verify has enough funding to last through September.
What now?
E-Verify’s supporters have been trying to secure a long-term future for the program since the end of last year, but to no avail. The program was first set to expire in November, before a six-month extension was signed by Congress.
That was after ten- and five-year extensions both failed to pass.
What does the future hold? Experts don’t expect calls for a big extension to go away any time soon — Obama has expressed his support for E-Verify, and many members of Congress will likely follow suit.
However, given the program’s recent setbacks, its future is less clear than ever. We’ll keep you posted on any new developments.
Have you used E-Verify? Should the program be extended or just go away? Let us know your opinion in the comments section below.

The politicians ,the governors, judges, police chiefs and lowly representatives, who ignored the illegal immigration occupation in a impoverished foreign country, would have been assassinated by now. That is not condoned in a civilized nation like ours, but we do have a remedy of throwing the rogues out of office in 2009. That’s when majority leader Sen. Harry Reid (D-NV) , his accomplice House Speaker Nancy Pelosi (D-CA) and 48 democratic indentured servants, who have sold their soul to the wealthy business fraternity—and outlawed E-VERIFY— start looking for our votes. The Stimulus/ Omnibus we thought was to return US workers/legal residents back to work? The President of the Heritage Foundation Robert Rector stated in an earlier interview that the E-Verify loophole, would give access to 300.000 construction illegal alien laborers. Rector has suggested that visa over-stays and border jumpers have infiltrated the job market—not just low paid, but high paying, blue collar–white collar and even professional positions.
E-Verify would have started to remove the stigma of illegal aliens from the workplace, opening hundreds of thousands more jobs for the legal population in this economic subsidence. For more understanding how the American people have been brain washed by the leftist press. Go to NUMBERSUSA, JUDICIALWATCH, CAPSWEB, FAIR AND AMERICANPATROL. Call your representative in the Senate or House: 202-224-3121
Incidentally don’t trust the cloaked Council of Foreign Relations, as they are involved in this portentous NORTH AMERICAN UNION arrangement. They see our nation as a merger of Canada, Mexico and this sovereign land, with open borders and the free movement of foreign nationals. Read about Europe where the different European country have been saturated with labor from foreign lands, where even in Britain the indigenous people are in direct competition— with civil unrest brewing.
Not surprised that the President and a democratic control congress would drop the requirement of e-verify. After all it is all about the votes to stay in power. The State of Missouri will require the use of e-verify to apply for any job training funds beginning June applications of 2009. Our company has enrolled and is currently using the system. At least it requires a photo ID and you can check A list documents on line to compare photos. A Republican controlled Governor and legislator passed and signed this requirement into law to protect American Jobs.
“E-Verify doesn’t do much to prevent identity theft. If an undocumented employee uses another person’s name and social security number, the system won’t tell employers that — it only matches names and SSNs.”
linked article from 9/5/08
I have used E-Verify since its inception as a pilot program and have experienced absolutely no problem with this system of verification. In most cases, you have a picture to go by and obtain verification from two federal agencies rather than one. And, when Immigration comes knocking at your door, you know, as the system administrator, you’re going to pass with flying colors for the Company. Yes, of course, there’s always a way for someone to “beat” the system but E-Verify cuts down those opportunities to virtually nothing. I guess I don’t understand why everyone seems to be so adamant to get rid of it. It certainly beats the old method of calling the Social Security Administration and running names and numbers by them for an approval/disapproval.
We were mandated by our state legislature to start using using E-verify beginning Jan 1, 2009. It sems to work although it was time consuming to learn and, like every other government mandate, we were expected to comply with no compensation for the additional resources we had to expend. In addition, I’m not sure how effective the system really is and if the funding expires later this year, I’ll never know, but we will have expended a lot of effort for very little return.
You have to use some judgement by looking at the picture Mike, I have had a good success rate using this system probably 98% I would say. I like it because it take the guess work out of trying to identify undocumented workers. E-Verify works great and I hope we can keep it and it’s easy to use and understand. I wish more employers would catch on instead of taking a big risk.
E-Verify also checks pictures on file with DHS against pictures on ID given by associate to prove their work eligibility. That only works for permanent residents and aliens registered to work until specific date and only if they presented a green card or a work authorization. But it is effective. E-Verify also catches discrepancies in the name, if for example someone got married, but did not change their name with appropriate authorities. So, it is pretty effective. And I am disappointed that it might go away.
We have been using E-Verify from the earliest days when it was first introduced at all of my various locations. The Web based version is extremely easy to use. It takes only a minute to keypunch the information straight from the Form I-9 and then it takes less than a second for the results to come back. About 98% of our verifications come back as Employment Authorized. The remainder are usually resolved within 24 to 48 hours. None of my locations has eever encountered all these inconveniences that we hear about regarding difficulty of use, extra time required from the administrative staff, erroneous non-confirmation, etc. Whenever we get a tentative non-confirmation we aske the person to go to local SSA office, or to call the DHS toll free number and the matter gets resolved in one or two days.
The one aspect of the system that must be improved is the SSN confirmation part. There must be a way where E-Verify lets the user know that a particular SSN is being currently used at another employer and possibly another state; and maybe assigned to another name (they don’t have to tell use the name in keeping with privacy laws). I believe that this information would go a long way to mitigate the current epidemic of identity theft.
Don’t let the system expire. It is the only tool we have.
Why does everyone assume that illegal workers are Hispanic “border-jumpers”? The toughest employee verification issue I’ve encountered was a Canadian, and at least here in NJ, I’ve heard from colleagues that their biggest problems have been European of some sort — all with snowy white complexions and perfect English. Don’t make this a racial issue.
E-verify has been the best method of document verification. Letting it go will set us back years versus moving forward.
I would be in favor of a small tax placed on companies to keep this program funded. It has helped me in my position to eliminate 25 illegal aliens, which by the way were Hispanic and most of them spoke perfect English. What I don’t understand is how in the world these people were issued certificates from the State of California for nursing?! I had one lady beg me not to call DHS on her. I told her that’s not what we are obligated to do; we just couldn’t have her employed. Another lady presented a “Driver License” with a curtain in the background of her picture and said she was a citizen of the US. E-Veify proved she wasn’t.
let’s see-we will not be able to verify legal status, obviously the government doesn’t want to be responsible-but if we hire someone with the right documents and they turn out to be bogus, we go to jail! what is wrong with this picture? the government has enacted laws against illegal immigration but they don’t enforce it. Employers are supposed to do their work for them. yes there are companies that knowingly hire illegals but what about the rest of us. where do we stand?? i have relatives who are in law enforcement that have stopped truckloads of illegals-they call INS and are told to let them go.
it is time to clean house in WASHINGTON! WE HAVE A BUNCH OF LAWYERS DESTROYING EVERYTHING.
The problem is that when 95% or more of the illegal workers coming into the USA ARE Hispanic “border-jumpers” it is a racial issue. Just as is the Muslim terrorists problem. When 95% of the Muslim world believes that anybody not Muslim must convert or die it is hard to NOT worry when they sit across from you on the plane. This fact is a good indication that when you meet someone that is Muslim even in the US he has an agenda when he is near you.
Just because you have a few non-hispanic/non-spanish speaking problems doesn’t mean that we don’t have a problem in this country. If you lived in Texas or any of the other Southern States you would know this. Does this mean we are prejudice? NO. 38% of our work force is of Hispanic heritage. Several don’t speak English but this doesn’t stop them from getting a job here and being promoted.
Fred, where do you get your statistics? I’m surprised that there is a solid percentage for counting the nationalities of “illegal workers”. But, I’m guessing statistics don’t mean much when EVERY Muslim is out to get you.
I feel sorry for people who live in fear of the world around them.
I don’t have a problem with using a centralized database to verify employment eligibility. I DO have a problem with being jerked around and having my time wasted already spread too thin by the myriad of other new mandates. For example, we already have to enter all new employees in a national new hire registry. Why can’t that already existing database be modified to be able to complete both these tasks? My staff’s checklist gets longer and longer and our jobs are less and less creative. If I’d wanted a degree in employment law, I would have gone to law school instead of getting an MBA!
SUSANNA,
Don’t we pay enough taxes?!! Clean up Washington and every government agency and it can operate efficiently. We already have a department of commerce that creates no commerce, a department of energy that creates no energy, a department of housing and urban renewal that creates no housing and does no urban renewal, and every other department that impedes commerce. It is time for someone to wake up! We are in a world market and all we want to do is punish manufacturers. Does any understand why we don’t make anything in this country any more? We compete against countries who don’t have OSHA-EPA-work comp-vacations-retirement-health insurance etc. And the government thinks when they need money-tax the corporations. We are a company who employed 90 plus and now employ 60 plus. We are taxed higher than large corporations. EVERY DAY WE ARE CONFRONTED WITH NEW REGULATIONS THAT ARE DREAMED UP IN WASHINGTON AND OUR STATE. When we run out of money we’re done. When Washington runs out of money they take more. ENOUGH!!!

If you would take time to look around and then do some research rather than just listen to the news or your local feel good group, you would know that there are people in this world that HATE the United States. This includes entire people groups especially those living in the US. Have you seen what the Muslims are doing in Great Britain and other non-islamic countries? Even the police are afraid to go into their areas where they live. They are trying to take over everywhere they live. This very hatred for the US is the reason we were slowed in Indonesia when trying to help those ravaged by the Tsunami. 911 happened because we didn’t take this threat seriously.
By the way, I have no fears.
Fred, how on earth did you find your way into an HR website. Fox News has their own site.
Fred: Why must you pinpoint Hispanics? The problem is with all races; not just with Hispanics. I fully respect those who go out to get a job, however, it must be done in a legal manner. Our country is filled with thousands of lazy individuals who take advantage of our system. Several sit at home on food stamps and unemployment; I see several Hispanics out in the streets looking for a job; willing to do anything; willing to take any mediocre job. I have a really big heart and would love to help them, but they must attain their job legally. It is really not a “racial” issue! Look at the Hispanic percentages on the east coast – not many………. Of course the border states will receive an abundance of illegal immigrants from the nearby country. That is a fact.
Illegal immigrants are everywhere and to stay in compliance with the laws that govern our country, E-Verify must continue. It takes the guessing off of our hands. As several have stated, it gives you a picture of the employee. If everyone does their job completely, it’s a win win situation.
Fred, how on earth did you find your way into an HR website? Fox News and Rush Limbaugh each has their own site.
Theresa,
They are not illegal immigrants. They are illegal aliens. I am not making anything a racial issue. The problem is that we have an open border to the south that let’s millions of people in the US illegally. They are law breakers. I know they just want a job and they are coming to the US to try and better themselves. We have several at my business that have gone through the proper channels and more than a few have obtained citizenship. It is not fair to these people who have worked hard for this honor. I am not against anybody that comes to the US legally but when the majority of those entering our country illegally are from Mexico it can’t help being a racial issue and not of my doing. Their own president gives them information on how to cross the border and not get caught. He knows that American dollars will be sent back to his country and will boost his economy.
And as far as taking shots at me and thinking me racial, I am very active in the Hispanic community. I help teach English as a second language at our Church. I have personally served on a committee that bought land, built a church (of which I spent many hours helping to build along with a residence for the pastor), hired a hispanic pastor and deeded it all to them. I have been on the board that has worked for the past 5 years to help those underprivileged indians in the mountains outside of Tepic, Mexico. Over this time we have made 3-4 trips each year to teach, build and serve these people. So to repeat, I am not in this conversation for racially motivated issues, I am here because there are some things that are right and some that are wrong and coming to our Country illegally is against the law and if you happen to be one of millions that are doing it then don’t cry foul when you get picked up and sent back; especially if you don’t speak English.
Fred, it is my deepest hope that you are an HR imposter. I would hate to think that an individual that has your thought process would be have responsibilities to enforce employment law. You are over the top and a liability to your organization.
Fred maybe I need to explain that a little more instead of a blanket statement. Though you listed a lot of nice things about yourself one has to assume that they are very selectively used qualities. Nothing wrong with that. But the way you express yourself about Hispanics displays a loathing that at least me is quite obvious. One way with some but quite different in context with others.
In one of your postings you did say that this was racial from your point of view. Then above you contradict that and say it is not. Well to admit it being racial shadows the self-serving statement made as an after thought. If you admit that then what other ethnic groups do you feel such feelings toward? Minorities maybe? As an HR employee our profession compels us to enforce, advocate employment law and not to first see race and seek a way to support personal negative stereotypes before even processing a potential employee. That is a failure of HR 101.
Yes there is a problem but we are speaking about people not some lower life form. Admitting to racism is not a badge of honor even if there is an immigration problem. I see no discernable difference in an illegal immigrant or an individual that admits to racism. Sorry
Thumbs up for E-Verify can’t imagine doing business without it now. Please Mr Obama don’t take it away we need it.
