E-Verify mandates on the rise

Right now, seven states require some or all employers to use the Department of Homeland Security’s E-Verify system to check the employment eligibility of new hires. Many more have legislation on the way.

The E-Verify system is a service from the Department of Homeland Security (DHS) that allows companies to submit new hires’ identification info online for verification. (More info here.)

Seven states require some or all employers to use the system. The states with E-Verify mandates are Arizona, Arkansas, Colorado, Georgia, Mississippi, Oklahoma, and Rhode Island.

In some places, requirements are just for public employers or companies that contract with the state. In others, such as Arizona and Mississippi, the mandate extends to all employers.

In at least 15 other states, some form of E-Verify legislation is still pending.
